Acceptable Use Policy

This Acceptable Use Policy applies to everyone who uses the Profit Catalyst App (the "Service"), operated by Dave Dunham. It is part of our Terms of Service. The short version: use the Service to market your own fitness business to people who agreed to hear from you, and don't abuse the platform.

1. Messaging Rules

The Service generates and helps you deploy email and SMS campaigns. You must:

  • Message only contacts who have given you the consent required by law (TCPA for SMS, CAN-SPAM for email, and any state or local rules)
  • Honor opt-outs promptly and keep suppression lists current
  • Identify yourself and your business truthfully in every message
  • Follow the policies of any connected CRM or sending platform

Purchased, rented, or scraped contact lists are prohibited on the Service.

2. Prohibited Uses

You may not use the Service to:

  • Send spam or unsolicited bulk messages
  • Make deceptive, fraudulent, or misleading offers, including fake discounts or false urgency about pricing
  • Market anything illegal, or market to people you know to be minors without parental consent
  • Harass, threaten, or abuse anyone
  • Upload content that infringes someone else's IP rights
  • Upload malware or attempt to breach, probe, or overload our systems
  • Access another user's account or data without authorization
  • Resell, sublicense, or share your account or our templates outside your own business without written permission
  • Scrape the Service or use it to build a competing product

3. AI Content Responsibility

AI-generated content is a draft, and you are the publisher. Review every generated email, text, caption, and ad before it goes out. You are responsible for the accuracy of claims, pricing, and guarantees in the content you send.

4. Fair Use of Platform Resources

AI generation and campaign features are subject to fair-use limits. We may throttle or restrict accounts whose usage patterns degrade the Service for others, and we will contact you first where practical.

5. Enforcement

We may investigate suspected violations and may suspend or terminate accounts that violate this policy. For serious violations (spam, fraud, security abuse) suspension can be immediate and without notice. Where the violation is minor and fixable, we will give you a chance to cure it first.
